JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511/34 of the Indian Penal Code.

The prosecution case is that the petitioner along with Sajo Sah entered into the house of the informant and attempted to ravish her.

It is submitted by the learned counsel for the petitioner that the petitioner is neighbour of the informant and due to dispute with regard to drainage the accusation has been levelled. It is further submitted that for the occurrence of 6.3.2015 at 2 A.M. the FIR was registered on 7.3.2015 at 9.15 AM which reached the court of the learned Incharge Judicial Magistrate on 9.3.2015

Patna High Court Cr.Misc. No.37641 of 2015 (2) dt.18-09-2015 2/2 which suggests that the FIR was registered after antedating. It is also submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below and even assuming the accusation no case under section 376/511 IPC is made out. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Begusarai in connection with Sahebpur Kamal P.S. Case No.93 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
