Patna High Court CWJC No.13961 of 2022(2) dt.09-05-2023 2/3 09-05-2023 The present writ petition has been filed seeking the following reliefs:- " For a Direction/Order to the State authorities to ensure the part performance of contract in between petitioner and Private respondents as per executed agreement to sale dated 10.06.2021 executed on the non-judicial stamp of Rs.1000/- taken on the estamp of Indian-Non-Judicial site of Government of Bihar issued dated 08/01/2021 vide Certificate No.1N-BR20318825 291488T under Document Reference SUBIN-BRBRSHCIL012646185606 whereby the Private Respondents have agreed to sale their land in favour of either petitioner or the person referred by petitioner namely 1. Swity Kumari wife of Sri Pramod Kumar, resident of Pandit Gali, Chowk Par, Biharsharif, P.S.
Biharsharif, District-Nalanda, who has already purchased Challan for registry with consent of original land owner Respondent 2nd set (R-9 to 11). 2. Smt. Lalmuni Devi, aged about 52 years, Female, wife of Sri Sanjay Kumar, resident of Nagar Nigam Colony, South, Punendru Nagar, P.S. + Post + Sub- Registry Office, Phulwarisharif, District-Patna. 3. Satyendra Kumar, aged about 26 years, Male, S/0 Ram Swarup Sao, resident of Mohalla-Ram Krishnanagar Ghana Colony, Gali No.7 P.S.-Ram Krishna Nagar, District-Patna.

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
