The petitioners seek regular bail in Barahara P.S. Case No. 194/2018, registered for the offence punishable under Sections 8, 20(b)(ii)(c), 22(c) of the N.D.P.S. Act. Learned counsel for the petitioner has submitted that 12.400 gms. of Ganja was recovered from joint possession of Anil Pathak (petitioner no. 1), Sunil Pathak (petitioner no. 2) and Vivek Pathak. Seizure list is part of F.I.R. which shows that recovery has been made from staircase room from the joint house of these petitioners. One of joint owner of the house, Vivek Pathak has been granted regular bail by this court vide order dated 30.11.2018 passed in Cr. Misc. No. 68722/2018.

Patna High Court Cr.Misc. No.74416 of 2018(2) dt.12-12-2018 2/2 Petitioners are in custody since 19.05.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Bhojpur at Ara in connection with Barahara P.S. Case No. 194/2018, subject to the condition that both the bailors will be close relative of petitioners.
