1. Heard the parties.
2. This is third attempt for regular bail on behalf of the petitioner in connection with Special Case No. 193 / 2020 arising out of Masaurhi P.S. Case No. 37 / 2020 dt: 18.01.2020 registered under Section 20 / 22 of the N.D.P.S. Act inasmuch earlier on two occasions prayer for bail was rejected vide orders dated 17.10.2023 & 20.09.2024 passed in Cr. Misc. Nos. 61971 of 2022 & 65565 of 2024.
3. As per the first information report 106 kilograms of ganja was recovered from the joint house of the petitioner and the co-accused / Ranjeet Kumar @ Ranjeet Yadav.
4. Learned counsel for the petitioner submits that the house from where contraband article has been recovered was joint
Patna High Court CR. MISC. No.55142 of 2025(3) dt.12-09-2025 2/3 property but there was a partition between the brothers and ganja has been recovered from the portion of the co-accused Ranjeet Kumar @ Ranjeet Yadav. He submits that petitioner is in custody since 23.05.2022 and this is third attempt of the petitioner for grant of bail. While rejecting the bail application of the petitioner vide order dated 20.09.2024 this Court had given liberty to the petitioner to renew his prayer for bail after nine months if the trial is not concluded. The trial has not been concluded and the custody period of the petitioner is more than three years. This Court vide its order dated 08.08.2025 called for a report regarding the status of the trial and in pursuance thereof learned Exclusive Special Judge (NDPS Act) Court No.
1, Patna has furnished the report. From perusal of the report is is evident that the case record is running on prosecution evidence and out of eight proseuction witnesses three witnesses have been examined and cross -examined. The trial court has given the expected time for conclusion of the trial within six months. The co-accused / Ranjeet Kumar @ Ranjeet Yadav has been enlarged on regular bail vide order dated 07.03.2025 passed in Cr. Misc. No. 4677 of 2025.
5. Regard being had to the submissions made by the parties, taking into consideration the period of custody, the fact that

No.55142 of 2025(3) dt.12-09-2025 3/3 the co-accused / Ranjeet Kumar @ Ranjeet Yadav has been granted regular bail by this Court, this is third attempt for bail on behalf of the petitioner and the petitioner is having no criminal antecedent, as such, I am inclined to grant regular bail to the petitioner.
6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000 /- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (N.D.P.S. Act) Court No. 1, Patna in connection with Special Case No. 193 / 2020 arising out of Masaurhi P.S. Case No. 37 / 2020 subject to the condition that the petitioner shall present himself before the trial court as and when required and in the event of failure on his part to appear before the trial court on two consecutive occasions his bail bond shall be liable to be cancelled.
