JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code.
The prosecution case is that the informant's Pulsar motorcycle was robbed by the miscreants when on chase one Raman Kumar was apprehended who suggested the name of the petitioner and on the basis of which the petitioner has been roped in the present case.
It is submitted by the learned counsel for the petitioner that co accused Raman Kumar has not specifically named the petitioner and the petitioner has been roped in the present case since father of the petitioner filed Complaint Case No. 1000C of
Patna High Court Cr.Misc. No.37605 of 2015 (2) dt.18-09-2015 2/2 2012 against the S.H.O., Teghra. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai in connection with Bachhwara P.S. Case No.62 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on verification of this fact that co accused Raman Kumar or any other accused has not named the petitioner specifically otherwise the petitioner will surrender and pray for regular bail.
