The petitioners apprehend their arrest in
Patna High Court CR. MISC. No.52442 of 2019(4) dt.15-10-2019 2/3 connection with Tilothu P.S. Case no. 84 of 2018, registered under Sections 146, 147, 152, 186, 189, 353, 323, 341, 504, 506, 332, 435, 427 and 120(B) of the Indian Penal Code. The accusation is that in the morning of 04.11.2018, on receiving information about blockage of national highway in protest of arrest of accused in Tillatuthu P.S. Case No. 83 of 2018, the informant and other Police personnel reached there then saw that mob of 100 to 150 people by burning of tire blocked the National Highway. The informant and other Police personnel made attempt to vacate the road, but they did not take any heed and started to abuse and scuffle with Police personnel. At that time, out of mob, 33 persons, including the petitioners, were identified by the Local Chowkidar.
Learned counsel for the petitioners submits that, although, petitioners are named in the F.I.R., but no specific overt act have been attributed against the petitioners. In fact, the name of the petitioners have been disclosed by the Chowkidar due to village dirty politics. Further submission is that petitioner Nos. 1 to 10 have no criminal antecedent while petitioner No.11 Shatrudhan Sah @ Shatrudhan Prasad is accused in two cases, as detailed in para-03 of the petition, but

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Dehri-on-Sone, Rohtas in connection with Tilothua P.S. Case No. 84 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
