Mr. Sri Rajballabh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-12-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Warsaliganj P.S. Case No. 360 of 2018, registered for the offence punishable under Sections 420, 467, 471, 419 and 34 of the Indian Penal Code.

The allegation is regarding the petitioners along with other accused persons having engaged in cheating by inducing the people to engage in lucky draw by taking huge amount of money for the purposes of registration for the said lucky draw.

The learned counsel for the petitioners submits that three co-accused persons had come to the village and they were into

No.74987 of 2018(2) dt.14-12-2018 2/2 the business of lucky draw, however, the petitioner has been falsely linked with the said people without there being any specific incident or example of having cheated any of the villagers. Thus, in nutshell, the submission of the learned counsel for the petitioner is that no loss was caused to any of the villagers on account of any misdeeds of the petitioner, though, no incident of misdeeds of the petitioner could be narrated by the informant. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 05.10.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Warisaliganj P.S. Case No. 360 of 2018.
