JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2018 The petitioners seek bail in connection with Muffasil P.S.Case No. 310 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 .
Allegation is of recovery of 1627 litres of English wine and they have been made accused.
Submission of learned counsel for the petitioners is that liquors were kept by some Dabang persons of the society and seeing the police they fled away though petitioners were arrested. He submits that petitioner no. 1 is a lady and moreover both petitioners are in custody for more than three and half months having no criminal antecedent.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.74775 of 2018(2) dt.18-12-2018 2/2 circumstances, as stated above, as there is recovery of huge quantity of liquor, I am not inclined to enlarge the petitioners on bail. However, trial court is directed to expedite the trial and conclude the same within a period of three months from the date of receipt of a copy of this order and if it is not concluded within the stipulated period, they may renew their prayer of bail.
