Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Sessions trial no. 181/2018 arising out of Nardiganj P.S. Case no. 179 of 2014 registered for the offence punishable under sections 364, 302 and 201/34 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected on 28.02.2020. On the last occasion, report was called for regarding stage of the trial. Report of the trial court has been received vide letter dated 14.06.2021 from which it appears that out of six charge sheet witnesses, only one witness has been examined and for procurement of further evidence, summons and bailable warrant have been issued.

Patna High Court CR. MISC. No.9807 of 2021(3) dt.19-07-2021 2/2 Considering the nature of the allegation and the stage of trial, bail application of the petitioner is rejected. As the petitioner is in jail custody since 05.02.2018, trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible.
