The petitioner seeks bail in Thakaraha (Bhitaha) P.S. Case No. 151 of 2014 registered u/ss 341, 323, 504, 506,379, 448, 316,120(B) & 427 IPC. The petitioner being the neighbour is alleged to have entered into the house of the informant and thereafter assaulted and abused her.

Counsel for the petitioner referring to the injury report (Annexure-2) submitted that the injury sustained by the informant is simple in nature. The petitioner has no criminal antecedent and is languishing in jail since 17.09.2014. The charge sheet having already been submitted and as such there is no chance of tampering with the evidence.

No.48187 of 2014 (2) dt.04-03-2015 2 / 2 Regard being had to above, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Bagaha, West Champaran in connection with Thakaraha (Bhitaha) P.S. Case No. 151 of 2014 on conditions that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge the petitioner shall continue to appear in person on the date(s) fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel the bail bonds and secure his arrest in accordance with law.
