JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT & ORDER Date: 02-01-2018 This application has been filed, under Article 226 of the Constitution of India, seeking direction to the Bihar School Examination Board (in short 'the BSEB') for issuance of marks sheet of the petitioner of having passed matriculation examination in the year 2009. The petitioner also seeks direction to accept her request for correction of her father's

Patna High Court CWJC No.2205 of 2017 dt.02-01-2018 2/2 name and the date of birth in her marks sheet.

2. A counter affidavit has been filed on behalf of the BSEB, stating therein that after having looked into the petitioner's case meticulously, her marks sheet has already been corrected. It has also been stated that corresponding correction in the connecting record, i.e., tabulation register and data relating to the said matriculation examination, has been carried out as per the details and correction made in her marks sheet earlier. It has also been stated that the petitioner may obtain her corrected duplicate marks sheet from the office/counter of the Board in the manner prescribed. It has also been stated that the duplicate marks sheet will be issued with corrected data records, pertaining to the petitioner.

3. Considering the said averments made in the counter affidavit, this application appears to have become infructuous and is disposed of with an observation that the petitioner shall be at liberty to apply for issuance of duplicate marks sheet.
