The petitioner apprehends his arrest in connection with Complaint Case No.C-1267 of 2015/T.R. No.573 of 2015 registered under Section 138 of the Negotiable Instruments Act and Section 406 of the Indian Penal Code, pending in the court of the Judicial Magistrate, First Class, Muzaffarpur (West). The accusation is that the two cheques issued by the petitioner in favour of the complainant were dishonoured and in spite of that, the amount of the cheque was not paid by the petitioner to the complainant.
Having considered the facts and the circumstances of
Patna High Court Cr.Misc. No.33297 of 2016 (2) dt.31-08-2016 2/2 the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within six weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
