Mr. Sri Sanjay Kumar Tiwary 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks bail in connection with Sheohar P.S.Case No. 14 of 2018 registered under Sections 364 and 365 of the Indian penal Code.

Allegation against the petitioner is of kidnapping the son of the informant.

Submission of learned counsel for the petitioner is that petitioner is the daughter-in-law of the informant and wife of the victim Ram Ekbal Raut and petitioner had filed a maintenance case No. 8 of 2016 and in that case maintenance was allowed to the petitioner and due to the aforesaid fact, this case has been lodged against the petitioner making false allegation and considering the same a co-ordinate Bench of this Court has allowed prayer of bail of one co-accused vide order dated 27.06.2018 passed in Cr. Misc. No. 35509 of 2018 and

Patna High Court Cr.Misc. No.73973 of 2018(2) dt.17-12-2018 2/2 petitioner is in custody for about one and half months. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sheohar in connection with SheoharP.S. Case No. 14 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
