ANJANA MISHRA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Barsoi P.S. Case No. 86 of 2016 for the offences registered under Sections 147, 148, 149, 188, 341, 323, 325, 307, 332, 333, 353, 427, 337, 338, 379 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that there was some disturbance in the election of the Mukhiya caused by the crowd which had assembled. The petitioner is said to be a members of the crowd which caused disturbances in the counting of votes. It is further submitted that other similarly situated co-accused persons have also been extended the

Patna High Court Cr.Misc. No.32880 of 2016 (2) dt.05-10-2016 privilege of anticipatory vide order dated 15.09.2016 passed in Cr. Misc. No. 32837 of 2016.

Considering the aforesaid facts and circumstances of the case and the nature of allegation made against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Barsoi P.S. Case No. 86 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
