JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 Petitioner prays for bail in connection with Jamui P.S.Case No. 469 of 2018 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code. Allegation is of committing theft in the shop of the informant and FIR is against unknown and later on petitioner was arrested during investigation.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him, there is no recovery from his possession and he is in custody since 19.9.2018. Further submission is that though it is alleged in the impugned order that petitioner is accused in five other cases but as a matter of fact he is accused in three other cases, which is an error of record and for that a supplementary affidavit has been filed.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Jamui P.S.Case No. 469 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
