The petitioner seeks bail in anticipation of his arrest in connection with Manjhi P. S. Case No. 70 of 2018 dated 01.04.2018 instituted for the offences under Sections 366(A) and 34 of the Indian Penal Code.

The uncle of the victim girl has alleged that she did not come back from her college. Later, during the course of search, the mother of the victim girl intimated the informant that her daughter (victim) had telephoned her in the night telling her that she has been taken to Delhi by the petitioner for the purposes of marrying her.

Learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.72500 of 2018(2) dt.20-12-2018 2/2 that an absolutely false case has been lodged against the petitioner for oblique purposes. In support of the aforesaid contention, the attention of this Court has been drawn to the statement of the victim girl recorded under Section 164 Cr.P.C. wherein she has stated that she had fought with her sister and had run out of her house alone to her aunt's house at Haryana. Later, she was brought back home. Regard being had to the aforesaid facts as also the clean antecedent of the petitioner, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II at Chapra in connection with Manjhi P. S. Case No. 70 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
