This application for regular bail arises out of Pirbahore P.S. Case No. 248 of 2021 (Special Case No. 64 of 2021), disclosing the offence punishable under Sections 20/22 of the NDPS Act.

Learned counsel for the petitioner has submitted that the Ganja allegedly recovered from the petitioner's possession is of small quantity and, therefore, this Court should consider granting him privilege of regular bail.

From the statement made in paragraph-3 of the application it is noticed that the petitioner has long criminal history. In 2019 also a case was registered against him for the

Patna High Court CR. MISC. No.63444 of 2021(2) dt.07-04-2022 2/2 offence punishable under the NDPS Act. In such circumstances, I am not inclined to grant the petitioner privilege of regular bail for the present. It is however, observed that the court below should make endeavour to expedite conclusion of the trial. If the trial is not concluded within six months from the date of communication of this order, the petitioner shall be at liberty to renew his prayer for bail.
