JUSTICE RAKESH KUMAR ORAL ORDER 04-03-2015 Heard Smt. Rina Sinha, learned counsel for the petitioner and Sri P.K. Chaurasia, learned A.P.P. The petitioner, who is in custody in connection with Tekari P.S. Case No.209 of 2014 registered for the offence under Section 399/ 402 of the Indian Penal Code and Section 25(1-b)a/ 26/ 35 of the Arms Act has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner is in custody since 22.7.2014. She further submits that of- course nothing was recovered from the possession of the petitioner but it was falsely shown that one loaded country made pistol was recovered from the possession of the petitioner. It has further been submitted that petitioner has got no criminal antecedent.

Keeping in view the nature of accusation, period of

No.49451 of 2014 (2) dt.04-03-2015 2/2 custody as well as clean antecedent of the petitioner, let the petitioner namely Bittu Kumar be enlarged on bail on furnishing bail bond of Rs. 10000/- (Rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 209 of 2014.
