JUSTICE SUDHIR SINGH ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 363, 366, 366A and 34 of the Indian Penal Code.
Allegation against the petitioner is to have kidnapped daughter of the informant for the purpose of marriage. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is uncle of Jwala Singh @ Ujjwal Kumar, who is alleged to have abducted the victim girl for the purpose of marriage. From perusal of Annexure-2 to the present application it would appear that the victim girl has married nephew of this petitioner. The victim girl is present in the court in person and has filed an affidavit, same is kept on record. The victim girl in para-3 of her affidavit has stated as follows :- "That I my own sweetwill eloped with Jwala Singh @ Ujjwal Singh, son of Ram Kalewar Singh, resident of village-Kadma, Police Station-
Patna High Court Cr.Misc. No.39836 of 2015 (4) dt.30-10-2015 2 / 2 Rajepur, District-East Champaran and we both married. Now I am pregnant of about 7 months." On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances and the victim girl herself has admitted her marriage with nephew of the petitioner, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahana, in connection with Rajepur P.S. Case no. 18 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
