====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Special Case No. 3305 of 2019 arising out of Kadamkuan P.S. Case No. 173 of 2019 for the offenses under Sections 20, 22 of N.D.P.S. Act and 30(a) of Bihar Prohibition & Excise Act. Learned counsel for the petitioner submits that in the instant case total 8.882 kgs of ganja was seized. The petitioner is in custody since 30.05.2019.

Considering the fact that the quantity of ganja seized is not commercial quantity, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand)

Patna High Court CR. MISC. No.49960 of 2019(4) dt.03-02-2020 2/2 with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Special Case No. 3305 of 2019 arising out of Kadamkuan P.S. Case No. 173 of 2019, subject to condition that one of the bailors shall be the family member of the petitioner. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner in the present case.
