The petitioner apprehends his arrest in connection with Bakhri P.S. Case No. 163 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to high handedness of police. Petitioner is not named in the first information report. Further he submits that petitioner has got no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that the alleged recovery of illicit liquor has been made from the motorcycle which is registered in the name of the petitioner.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner.
