Petitioner in the present case is seeking the following reliefs:- " I) For Direction/ order to the respondents authority concern to enquire into the false implication and institution of an F.I.R bearing Dighwara P.S. Case No. 138/2020 dated 23.05.2020 u/s 341 /323 /324 /307 /506 /504 /34 of Indian Penal Code with a completely false and concocted story.
ii) For Direction/ Order to the
Patna High Court CR. WJC No.1171 of 2022(2) dt.17-11-2022 2/3 respondents- authority concern to punish the prosecution either private or State in the participation of role played in the institution of such types of false and fabricated case only to harass to the people like petitioner for which they are entitled under the criminal procedure code. iii) For Direction/ Order to the respondents to pay the compensation of period spent by the petitioner in jail and harassment by mental, economical and important age of time with defamation as a consequential relief of relief no. (ii) prayed in this petition.
iv) For the order relief/ reliefs as your lordships may be deem fit and proper in the facts and circumstances of the case."
Learned counsel for the petitioner submits that at this stage, the only concern of the petitioner is that the case in question be properly investigated and the fact that he was taken into custody on 13.01.2021 and released from the jail on 08.02.2021 for no plausible reason be also examined by some responsible officer of the investigating agency. Mr. Irshad, learned AC to SC-1 for the State submits that in the given facts and circumstances of the case, to instill confidence in the ongoing investigation of the case, this Court may pass appropriate order.
Having regard to the facts and circumstances of the case and the submissions noted hereinabove, this Court directs the Superintendent of Police, Chapra (Respondent No. 4) to
Patna High Court CR. WJC No.1171 of 2022(2) dt.17-11-2022 3/3 look into the grievance of the petitioner, examine the same and upon proper supervision of the case in question at his end, appropriate order be issued to the I.O./ any supervising authority to submit police report within a reasonable period. This writ application stands disposed of with the aforesaid directions.
