The petitioner seeks regular bail in connection with Harlakhi P.S.Case no.79 of 2018 dated 28.4.2018 (G.R.No.283 of 2018) corresponding to S.T.No.276 of 2018 registered for offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is the step mother of the deceased and the allegation against her is that she received information that his step son has been apprehended by a shop-keeper and they are assaulting him and on that information the petitioner went there and brought his step son back and thereafter assaulted him and tied his hands and legs, due to which he died. Submission of the learned counsel for the petitioner is

Patna High Court Cr.Misc. No.73437 of 2018(2) dt.13-12-2018 2/2 that she has been falsely implicated in this case as a matter of fact her step son was brought back by the petitioner and now she is in custody since 28.4.2018.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that the cause of death is throttling. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner however, as it appears that the sessions has commenced as such the learned trial court is directed to expedite the trial.

With the aforesaid observation, this application is dismissed.
