JUSTICE PARTHA SARTHY ORAL ORDER 28-07-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Jaynagar P.S. Case no. 58 of 2020 registered under section 379 of the Indian Penal Code.

As per allegation in the F.I.R., the informant who had parked his motorcycle and gone for darshan in the temple, on return found the same missing.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The petitioner was falsely implicated during course of investigation. No incriminating material has transpired to implicate the petitioner. Referring to the seizure list it is submitted that the informant's

Patna High Court CR. MISC. No.9881 of 2021(4) dt.28-07-2021 2/2 motorcycle was not recovered from the petitioner's possession. He is in custody since 9.3.2020 and has no criminal antecedent. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for 1 year 4 months, the petitioner is directed to be enlarged on bail in connection with Jaynagar P.S. Case no. 58 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani.
