====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Asarganj P.S. Case No. 49 of 2015 instituted for the offence under Sections 147, 148, 149, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that there is case and counter case between the parties. Counter case has been filed by father of petitioner vide Asarganj P.S. Case No. 48 of 2015 in which petitioner has sustained gun shot injury in his hand.

In the instant case it is alleged that petitioner fired shot, on account of which Bhagina of the informant namely, Karelal Yadav sustained minor injury.

Patna High Court Cr.Misc. No.74712 of 2018(2) dt.20-12-2018 2/2 The injury report has been enclosed as Annexure-4 from which it appears that Doctor has found black spots present on the anterior enface of the chest near left nipple which was opined to be dangerous to life.

Petitioner is in custody since 1.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Asarganj P.S. Case No. 49 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
