1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323 and 353 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and has been falsely implicated in the instant case. It is also submitted that no doubt, the seized trailer belongs to the petitioner, but then, he was not present at the place of occurrence, nor sand was recovered from the trailer. It is also submitted that petitioner was completely unaware that the person, who had taken the trailer for some work, would misuse the same for some ulterior purpose.
4. Learned A.P.P. opposes the anticipatory bail

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Main (Paibigha O.P.) P. S. Case No.144 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
