The petitioner seeks bail in Dumraon P.S. Case No. 205 of 2018 instituted for the offence under Sections 30(a) / 41(1) of the Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that petitioner was not apprehended on spot. One person namely, Vijay Yadav was apprehended. He disclosed the name of co-accused Tufani Yadav who has managed to run away. Co-accused Abhishek Kumar Pandey was arrested by the police from Apache Motorcycle. He disclosed before the police the name of petitioner who managed to run away.
From the seizure list it appears that there is no
Patna High Court Cr.Misc. No.75425 of 2018(2) dt.18-12-2018 2/2 recovery of any illicit liquor from possession of the petitioner. Petitioner is in custody since 19.9.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-Special Judge Excise Act, Buxar in connection with Dumraon P.S. Case No. 205 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioners.
