The petitioner has remedy of appeal against the impugned order dated 23.08.2020, whereby the petitioner's fertilizer retail licence has been cancelled, under Fertilizer (Control) Order, 1985, which he has not availed before coming to this Court against the said order.

Considering the facts and circumstances, this

Patna High Court CWJC No.3740 of 2021(3) dt.22-01-2022 2/2 application is disposed of with a liberty to the petitioner to challenge the impugned order by preferring an appeal before the Appellate Authority.

If any appeal is preferred within four weeks from today, considering the fact that the petitioner was pursuing his remedy before this Court by filing present writ application, any application seeking condonation of delay in making appeal shall be favourably considered and petitioner's appeal shall be decided on merits.
