ANJANA MISHRA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Aurai P.S. Case No. 51 of 2016 registered for the offences punishable under Sections 47(A), 54, 57 and 63 of the Bihar Excise Act.

Learned counsel for the petitioner submits that though he is working at Delhi and no connection with any of the shops of Shyam Sundra Rai Market yet, the name of the petitioner has been unnecessarily brought into in connection with the present case. It is further submitted that there is no recovery from his conscious possession.

Considering the above facts and circumstances of the

Patna High Court Cr.Misc. No.32634 of 2016 (2) dt.28-10-2016 2/2 case and also that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Tripathi, Judicial Magistrate 1st Class, Muzaffarpur in connection with Aurai P.S. Case No. 51 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) ravi/- U T
