2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 413, 414, 467, 468/34 of the Indian Penal Code.
3. As per prosecution case, all the F.I.R. named accused persons committed theft of motorcycle.
4. Learned counsel for the petitioner submits that no stolen article has been recovered from the conscious possession of the petitioner. Name of the petitioner transpired on the basis of confessional statement of co-accused Rajnish Kumar. Petitioner claims clean antecedent.
5. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that
Patna High Court CR. MISC. No.53792 of 2023(2) dt.24-08-2023 2/2 let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P. S. Case No. 228 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
