2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 379, 461 of the Indian Penal Code, registered in connection with Paharpur P.S. Case No. 193 of 2023.

3. As per prosecution case, when the informant went for participating in the marriage party, theft was committed in his house and some articles were stolen away.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged occurrence. No incriminating article has been recovered

No.56143 of 2024(2) dt.19-08-2024 2/2 from the conscious possession of the petitioner rather he has been made accused in this case only on the basis of statement made by informant that at the time of occurrence he was moving near his house. Petitioner is in custody since 24.06.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XI, East Champaran, Motihari in connection with Paharpur P.S. Case No. 193 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
