ANJANA MISHRA ORAL ORDER 2 16-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 467/468/471/419/420/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation has been made against the petitioner that on the basis of fake certificates, the petitioner has received the amount of Indra Gandhi National Bridhawastha Pension Yogna, but the petitioner categorically asserts that not a single paise had been received by him on account of the said head. He further submits that it was the Gram Sewak who had been making false signatures of many persons for taking payment. It is further submitted that such an allegation against the petitioner has been made on mere suspicion.

Patna High Court Cr.Misc. No.32336 of 2016 (2) dt.16-12-2016 P2/2 Learned counsel for the petitioner further brings my attention to an order dated 07.09.2016 passed in Cr. Misc. No. 35915 of 2016 in which one Arbind Kumar Singh had also received some money, had been granted conditional bail after submission of the amount alleged to have been taken by him. So far as the present petitioner is concerned, no particular amount has been alleged. Considering the aforementioned facts and circumstances, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Ben P.S. Case No. 26/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
