ANJANA MISHRA ORAL ORDER 09-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Sakari P.S. Case No. 121 of 2015 for the offences registered under Sections 413, 414, 467, 468, 401 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a garage owner and several vehicles come for repairing and servicing. It is further submitted that he has no knowledge about the ownership and possession of any vehicle and he has been implicated in this case on the basis of confessional statement made by the co-accused, namely, Vishal Chauhan.
Considering the fact that the petitioner is merely a garage owner and that the vehicle in question has been parked in front of the garage and he is not expected to be in possession of the document of the vehicle which came to his garage for repairing
Patna High Court Cr.Misc. No.32939 of 2016 (2) dt.09-11-2016 and servicing, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Sakari P.S. Case No. 121 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
