JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-12-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Sarai Ranjan P.S. Case No. 124 of 2018, disclosing offence under Sections 147, 447, 341, 323, 324, 325, 307, 354, 435, 436, 452 and 380 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners has submitted that the informant and her daughter was said to have received injuries and were examined by the medical expert and injuries on them have been found to be simple in nature. He further contends that the informant side and side of the accused come from the same family and there is some animosity

Patna High Court Cr.Misc. No.73232 of 2018(2) dt.20-12-2018 2/2 between them. which is the reason behind lodging of the complaint case leading to the registration of the First Information Report under Section 156(3) of the Cr.P.C. From the First Information Report, it appears that accused persons, witnesses and the informant belong to the same family. Considering the above noted facts and circumstances, this application is allowed. The petitioners, above named, in the event of their arrest or surrender before the Court within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIth Samastipur in connection with Sarai Ranjan P.S. Case No. 124 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
