The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 33(I)(C) and 63 of the Indian Forest (Bihar Amendment) Act, 1989. It is a case of making illegal construction upon the forest land when the forest officials reached there for stopping the illegal construction work, the petitioner along with other objected.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner never constructed any hut in the forest are and he has no concern with the alleged constructed

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sumit Kumar, Judicial Magistrate, Ist Class, Gaya in connection with Gaya Forest Case No. 77 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
