The Court below by the impugned order, dated 09.03.2017, has rejected an application for appointment of Survey knowing Pleader Commissioner considering the stage of the suit. The order cannot be said to be beyond jurisdiction or illegal resulting into miscarriage of justice.

This application is, accordingly, dismissed.

It goes without saying that the petitioner shall be at liberty to apply for appointment of Survey knowing Pleader Commissioner at appropriate stage and the Court below shall be free to pass appropriate orders on such application. (Chakradhari Sharan Singh, J) arun/- U
