2. The petitioner apprehend his arrest in connection with Gaya Muffasil P.S. Case No. 669 of 2022, dated 31.08.2022, registered under Sections 147, 148, 149, 341, 323, 153(A), 295(A), 353, 504 of the Indian Penal Code.
3. The prosecution case, in brief, is that, as per written report of the informant Ram Pukar Chaudhary, who is the Police Inspector, that petitioner was involved in hot talk with a group of other community and had mishandled the Police party.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and allegation as alleged in the F.I.R. is not maintainable. The allegation of the petitioner being involved in communal rivalry is not sustainable. The Police Officer has dragged the petitioner on the basis of previous criminal antecedent. He further submits that no private person or any group have made any complaint against the petitioner.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.
6. Having considered the rival submissions made on behalf of the parties, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Gaya Muffasil P.S. Case No. 669 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
7. The Court below is directed to verify the
Patna High Court CR. MISC. No.54914 of 2023(2) dt.23-08-2023 3/3 criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in paragraph no. 3 of the bail application, this order will automatically loose its force.
