The petitioner seeks regular bail in connection with Excise Case nO.952 of 2018 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 of the Indian Penal Code.

Allegation against the petitioner is about recovery of more than 500 ltrs. of liquor from the vehicle and the petitioner was arrested from there.

Submission of the learned counsel for the petitioner is that the vehicle was not belongs to the petitioner and he has been falsely implicated in this case, having no criminal antecedent and he is in custody since 1.11.2018.

Patna High Court Cr.Misc. No.73551 of 2018(2) dt.14-12-2018 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage however, the learned trial court is directed to expedite the trial and try to conclude it within a period of three months and if not concluded the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
