Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 24-02-2016 Heard the counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 1165 of 2008 registered under Section 420 of the Indian Penal Code.
Looking to the complaint, it appears that the petitioner along with, another co-accused Rajdeo Singh played active role in deceiving the complainant in the name of sale of commercial plots in Gaya to him.
The counsel for the petitioner states that the petitioner would ensure that the amount paid by him for sale of the land is returned, if no sale of land is made in favour of the complainant. Some of the accuseds have been granted the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.39794 of 2015 (4) dt.24-02-2016 2/2 Mr. Sanjay on the contrary while opposing the prayer states that co-accused Rajdeo Singh and other accuseds of the case have surrendered and grant regular bail by the court below. Considering the allegations as also the materials on record, in my view, the petitioner should also surrender and seek bail in the court below contending that co-accused having identical allegation has been released on regular bail. The application is dismissed.
