Case no. 237/2014 registered under section 302/34 of the IPC and accordingly, both the above stated petitions are being disposed of by this common order.
Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.
Patna High Court Cr.Misc. No.50458 of 2014 (4) dt.26-03-2015 Petitioner in Cr. Misc. no. 50458/2014 is husband whereas petitioner in Cr. Misc. no. 45454/2014 is mother-in-law of the deceased.
No doubt, ligature mark was found on the neck of the deceased but admittedly, none has seen the actual killing of the deceased.
The contention on behalf of the petitioners is that deceased committed suicide due to petty family dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner in Cr. Misc. no. 50458/2014, namely, Jitendra Singh, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar Mufassil P.S. Case no. 237/2014.
So far as petitioner in Cr. Misc. no.45454/2014, namely, Chandrawati Devi @ Chandrawati Kunwar is concerned, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar Mufassil P.S. Case no. 237/2014.subject to condition as laid down under section 438(2) of the Cr.P.C.
