JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-11-2018 The issue of payment of salary requires verification of record as to validity of the appointment and continuation of service. Factual inquiry is to be made by the District Programme Officer ( Establishment) Darbhanga who has the advantage of verification of record.

The writ petition is accordingly disposed of with a direction to the respondent District Prgramme Officer (Establishment) Darbhanga, who shall inquire into the matter and if District Programme Officer (Establishment) find the appointment of the petitioner valid and petitioner has actually worked, he shall ensure payment for the period petitioner has actually worked.

Patna High Court CWJC No.13331 of 2015(2) dt.28-11-2018 2/2 Necessary decision in this regard may be taken by the respondent at the earliest preferably within a period of four months from the date of receipt/ production of a copy of this order.

It is made clear that the admitted dues should be paid to the petitioner within time frame. Failing which the entire arrears will carry interest at the rate of 9 per cent per annum from the pocket of erring officers/ employee of the Education Department.
