The petitioners seek bail in Supaul P.S. Case No.449 of 2018 registered under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act. On the allegation that some criminals assembled for committing cognizable offence, raid was conducted and both the petitioners and others were apprehended. From the possession of Santosh Kumar, petitioner No.1, one loaded country made pistol was recovered and from the possession of petitioner No.2, Biren Kumar, one live cartridge was recovered. The learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 31.07.2018.

No.73659 of 2018(2) dt.12-12-2018 2/2 Considering the aforesaid facts and nature of allegation made against the petitioners and the fact that the petitioners are in custody since 31.07.2018, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.449 of 2018.
