The petitioner seeks regular bail in connection with Balrampur P.S.Case No.121 of 2016 dated 30.10.2016 registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition of Excise Act, 2018 .

Allegation against the petitioner is about recovery of 89.3 ltrs. of liquor from the vehicle, which is said to be of the petitioner.

Submission of the learned counsel for the petitioner is that he is not owner of the vehicle, having no criminal antecedent and he is in custody for more than two months. Heard learned A.P.P. also.

No.73430 of 2018(2) dt.13-12-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge-IIcum-Special Judge, Excise Act, Katihar in connection with Balrampur P.S.Case No.121 of 2016.

With the aforesaid observation, this application is allowed.
