The petitioner is seeking anticipatory bail in connection with Kutumba P.S. Case No. 112 of 2018 registered under Sections 452, 379 and 354 of the Indian Penal Code. Learned counsel for the petitioner submits that in this case the First Information Report has been lodged ten days after the alleged occurrence. Both the informant and the petitioner are own gotias and they are admittedly having land dispute and a proceeding under Section 107 of the Cr.P.C. is initiated against them and thus the petitioner has filed representation before the Superintendent of Police intimating that it is a case of false implication.

In the given facts and circumstances of the case, in the event of his arrest/surrender before the court below within a

No.75229 of 2018(2) dt.20-12-2018 2/2 period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kutumba P.S. Case No. 112 of 2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
