JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.01.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is in jail custody since 01.09.2014 in a case registered under sections 341, 379, 376,511 and 354 of the IPC.

The accusation against the petitioner is that he attempted to commit rape upon the informant but submission on behalf of the petitioner is that father-in-law of daughter of the petitioner is full brother of the informant and there was matrimonial dispute between daughter of the petitioner and her husband and when the petitioner went to pacify the matter, he was caught and handed over to the police with false allegation.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.51792 of 2014 (2) dt.05-01-2015 as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur, Patna in Bihta P.S. Case no. 631/2014.
