====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 1947 of 2012 registered under Sections 392, 323, 364/511 and 307/34 of the Indian Penal Code. The accusation is that when the sister of complainant/informant had gone to Civil Court, Purnea in connection with Pairvi of her case lodged, under Section 498A of the Indian Penal Code, against her husband and other in-laws then petitioner and other accused persons assaulted the sister of informant and tried to kidnap her.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.35094 of 2016 (2) dt.02-09-2016 petitioners have no concern with the family members of in-law of sister of complainant/informant. It is further submitted that on the basis of complaint petition of complainant/informant, police case was instituted, in which, police submitted the final form, thereafter, on protest, cognizance has been taken against the petitioners. It is further submitted that similarly situated coaccused, Upendra Bishwa @ Upendra Nath Bishwas, Arjun Bishwas, Satish Kumar, Baidya Nand Bishwas @ Bidyanand Mandal have already been granted privilege of anticipatory bail by this Court vide order dated 03.05.2016 passed in Criminal Misc. No. 10897 of 2016.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Purnea, in connection with Complaint Case No. 1947 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U
