The petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 89 of 2018 for the offenses punishable under Sections 399 and 402 of the Indian Penal Code. The case of the prosecution as per the FIR is that on 12.02.2018 at about 3:40 P.M. the police force had reached at the alleged place from where the petitioner and others were apprehended and had found that the accused persons were preparing a plan to commit dacoity. As far as the petitioner is concerned, a knife is said to have been recovered from his possession.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case
Patna High Court Cr.Misc. No.69900 of 2018(2) dt.12-12-2018 2/2 and in fact allegation is only with regard to hatching a plan to commit dacoity and there is nothing on record to show that the dacoity has been committed by the petitioner. It is submitted by the learned counsel for the petitioner that similarly situated coaccused persons have been enlarged on bail by order dated 19.09.2018 passed in Criminal Misc. No. 50609 of 2018 as also vide order dated 06.10.2018 passed in Criminal Misc. 52989 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 89 of 2018.
