The petitioner seeks bail in Sessions Trial No.98 of 2018 arising out of Haweli Kharagpur P.S. Case No. 181 of 1993 registered under Section 307 and other Sections of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner was granted bail but during the course of trial, the petitioner is said to have misused the privilege of bail for about nine years. Petitioner is in jail since 09.10.2017. Prayer for bail of the petitioner was earlier rejected vide order dated 13.03.2018 passed in Cr. Misc. No.14337 of 2018. Petitioner has already remained in jail for about 14 months for misuse of bail.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.72177 of 2018(2) dt.11-12-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in connection with Sessions Trial No.98 of 2018 arising out of Haweli Kharagpur P.S.
