The petitioner has filed an affidavit that he submitted bail bond but the learned Presiding Officer did not accept his bail bond. The matter is very serious that if the bail bond is filed the Presiding Officer has no business to return the bail bond, his duty is to accept or reject the bail bond. But the learned Chief Judicial Magistrate, Bhagalpur has reported that no bail bond has been filed in pursuance of the order dated 02.07.2015. The surrendering of the petitioner is extended for three weeks from today and the learned counsel for the petitioner is directed to submit the bail bond before the court who is in seisin of the case in Kahalgaon P.S. Case No. 65 of 2013 and the court

Patna High Court Cr.Misc. No.38106 of 2015 (4) dt.16-09-2015 2/2 below shall pass order in accordance with law. With the aforesaid observations, this modification petition is disposed of.
