The petitioners seek bail in Bihta P.S. Case No. 1015 of 2018, instituted for the offences under Sections 307,353,34 of the IPC and Section 4/40 of the Bihar Minor Mineral Concession Rule, 1972 and Section 3, 6 and 8 and also under Section 27 of the Arms Act.

It is alleged that the informant got information that accused persons are tilling illegal sand and loading on the boat. Police reached at the place of occurrence and thereafter, the accused persons made firing and in defence police also made firing and caught hold 11 persons including the petitioner.

Patna High Court Cr.Misc. No.72123 of 2018(2) dt.06-12-2018 2/2 Seizure list was prepared by the police which is part of the FIR which bear signature of one of the accused namely Anil Rai. As such there is general and omnibus allegation against these petitioners. They are in custody since 13.09.2018 having no criminal antecedent.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Danapur, Patna, in connection with Bihta P.S. Case No. 1015 of 2018. Both the bailors will be close relative of petitioners.
